Justification for the state
The justification of the state refers to the source of legitimate authority for the state or government. Typically, such a justification explains why the state should exist, and to some degree scopes the role of government – what a legitimate state should or should not be able to do. There is no single, universally accepted justification of the state. In fact, anarchists believe that there is no justification for the state at all, and that human societies would be better off without it.
Natural rights and legal rights
Some philosophers distinguish two types of rights, natural rights and legal rights. Natural rights are those that are not dependent on the laws or customs of any particular culture or government, and so are universal, fundamental and inalienable (they cannot be repealed by human laws, though one can forfeit their enjoyment through one's actions, such as by violating someone else's rights). Natural law is the law of natural rights. Legal rights are those bestowed onto a person by a given legal system (they can be modified, repealed, and restrained by human laws).
Rule of law
The rule of law is a political ideal that all citizens and institutions within a country, state, or community are accountable to the same laws, including lawmakers and leaders. The term rule of law is closely related to constitutionalism as well as Rechtsstaat. It refers to a political situation, not to any specific legal rule. The rule of law is defined in the Encyclopedia Britannica as "the mechanism, process, institution, practice, or norm that supports the equality of all citizens before the law, secures a nonarbitrary form of government, and more generally prevents the arbitrary use of power.
Philosophy
Philosophy (love of wisdom in ancient Greek) is a systematic study of general and fundamental questions concerning topics like existence, reason, knowledge, values, mind, and language. It is a rational and critical inquiry that reflects on its own methods and assumptions. Historically, many of the individual sciences, like physics and psychology, formed part of philosophy. But they are considered separate academic disciplines in the modern sense of the term.
Liberty
Liberty is the state of being free within society from oppressive restrictions imposed by authority on one’s way of life, behavior, or political views. In theology, liberty is freedom from the effects of "sin, spiritual servitude, [or] worldly ties". In economics, liberty means free, fair, and open competition, often referred to as a free market. Sometimes liberty is differentiated from freedom by using the word "freedom" primarily, if not exclusively, to mean the ability to do as one wills and what one has the power to do; and using the word "liberty" to mean the absence of arbitrary restraints, taking into account the rights of all involved.
Natural law
Natural law (ius naturale, lex naturalis) is a system of law based on a close observation of human nature, and based on values intrinsic to human nature that can be deduced and applied independently of positive law (the express enacted laws of a state or society). According to the theory of law called jusnaturalism, all people have inherent rights, conferred not by act of legislation but by "God, nature, or reason." Natural law theory can also refer to "theories of ethics, theories of politics, theories of civil law, and theories of religious morality.
State of nature
In Ethics and political philosophy, in social contract theory, religion, and international law, the term state of nature describes the hypothetical way of life that existed before people organised themselves into societies. Philosophers of the state of nature theory propose that there was a historical period before societies existed, and seek answers to the questions: What was life like before civil society?, How did government emerge from such a primitive start?, and What are the hypothetical reasons for entering a state of society by establishing a nation-state? In some versions of social contract theory, there are freedoms, but no rights in the state of nature; and, by way of the social contract, people create societal rights and obligations.
Libertarianism
Libertarianism (from libertaire, "libertarian"; from libertas, "freedom") is a political philosophy that upholds liberty as a core value. Libertarians seek to maximize autonomy and political freedom, and minimize the state's encroachment on and violations of individual liberties; emphasizing the rule of law, pluralism, cosmopolitanism, cooperation, civil and political rights, bodily autonomy, freedom of association, free trade, freedom of expression, freedom of choice, freedom of movement, individualism, and voluntary association.
Legitimacy (political)
In political science, legitimacy is the right and acceptance of an authority, usually a governing law or a regime. Whereas authority denotes a specific position in an established government, the term legitimacy denotes a system of government—wherein government denotes "sphere of influence". An authority viewed as legitimate often has the right and justification to exercise power. Political legitimacy is considered a basic condition for governing, without which a government will suffer legislative deadlock(s) and collapse.
Consent of the governed
In political philosophy, the phrase consent of the governed refers to the idea that a government's legitimacy and moral right to use state power is justified and lawful only when consented to by the people or society over which that political power is exercised. This theory of consent is historically contrasted to the divine right of kings and had often been invoked against the legitimacy of colonialism. Article 21 of the United Nations' 1948 Universal Declaration of Human Rights states that "The will of the people shall be the basis of the authority of government".
